Lontano Design will use your personal information to provide you with the service you expect.

Our customers are at the heart of what we do at Lontano Design; we want to provide products and services that help each customer feel and look their best, and this includes our customers having confidence in how we handle their personal information. We value the trust you place in us, whether you share it with us when you visit or make a purchase at one of our stores, contact us by phone or email, use one of our websites ("Websites"), or use one of our mobile applications ("Apps"). We will refer to the Websites, Apps, in-store activities, and communications with us as the "Services" in this policy. The purpose of this Privacy Policy ("Policy") is to explain how Lontano Design, Inc., including our affiliates, subsidiaries, and family of companies, collects and uses your personal information, to whom and when we disclose it, and the tools and options available to you to manage that information.

Any websites, mobile apps, or products that display or link to this Policy, as well as Lontano Design Services, are subject to its terms and conditions. Any website, mobile application, service, or product that does not display or link to this Policy or that has its own privacy policy is not covered by it. Our website is intended for people over the age of 13.

Lontano Design does not knowingly request or collect personal information from anyone under the age of 13 without the express permission of a parent or legal guardian. If you believe your child under the age of 13 has submitted personal information to Lontano Design without prior parental or legal guardian consent, please contact privacy@lontanodesign.com so that we can delete the information.

We collect personal information in the following ways:

Personal information is collected in a variety of ways, both directly and indirectly. We collect your information directly from you when you send us postal mail, email our customer service team, fill out a form on our Websites, place an order through the Websites or Apps, or provide information to one of our in-store team members. We may also collect your personal information indirectly through automated means, such as when you interact with our Websites or use our Apps. For example, when you interact with our Websites or use our Apps, we may use technologies to collect information about how you use the Websites or Apps. We may also obtain information about you from third parties, such as our affiliates and subsidiaries, social media platforms, or advertising partners.

When you provide us with personal information, we collect it.

  • We may collect personal information about you or your device directly as follows:

  • When you sign up for a Lontano Design account, you must provide personal information such as your name and email address. You have the option of providing us with additional personal information, such as billing, mailing, and shipping addresses, a phone number, and a payment method (e.g., credit card). If you make purchases through the Websites or Apps, you will also create a username and password, which we will use to confirm your identity and make it easier for you to make purchases on our Websites and Apps on subsequent visits.

  • If you join our Lontano Club, we will need your mobile phone number in addition to the Lontano Design account information you provide (as mentioned above).

  • You must provide your name, mailing address, email address, and phone number when applying for a credit account or managing an existing credit or debit account. Other information needed to assess your creditworthiness and verify your identity, such as your date of birth, social security number, income, and employer information, will also be required. We need this information to process your application, manage your account, and provide you with credit-related services. Please keep in mind that if you choose to link your card to another third-party website, they may use your information differently and have privacy policies that differ from ours; please read their privacy policies to understand how they collect and handle your information, as well as your options.   • When you shop with us, whether through the Websites or the App, we save your browsing history, what you searched for, including when you use our style personalization tools, what you have saved for later, and when you ask us to notify you when items go on sale or return in stock, as well as what you purchased (if you make a purchase).

  • When you interact with Lontano Design, including when you speak with a member of our sales team, visit a store, contact our Customer Care team, enter a contest or sweepstakes, respond to a survey, participate in a promotional activity, register for an event or appointment, or apply for employment, we collect information about you (applicants have access to our Careers Privacy Policy, which contains information on our collection and use of applicant and employee data).

  • When you sign up for email notifications, including marketing communications.

  • We may collect video recordings and photographs of you when you visit a store for security, to detect and prevent fraud, to prevent product loss or damage, to report incidents, and for operational purposes.

Personal information is obtained from third-party sources.

We may receive your personal information from the following third parties in order to better understand your preferences, operate our business, and provide you with products and services we believe you will enjoy:

  • You have interacted with Lontano Design and the Lontano Design family of brands and companies.

  • If you follow Lontano Design, Lontano Design Rack, or any of our brands on social media platforms such as Facebook, Instagram, Twitter, LinkedIn, TikTok, or Pinterest. We may collect personal information when you communicate with us through social media sites, or when you use social media platform or network functionalities, plugins, widgets, or tools in connection with our Websites (e.g., to log into an account, or to share inspiration, finds, purchases, and other content with your friends and followers on social media), or when you click "Share This" or "Like" buttons. We believe it is important to emphasise that if you make a post on a social media site, such as Facebook, Instagram, or Pinterest, or identify us in your social media feed by tagging us with a hashtag (#) or "at" (@), your personal information may become public and is subject to the privacy policies of those social media sites. We recommend that you read the privacy policies of any third-party sites you visit in order to understand their data collection and practises.

  • Third-party service providers that support our business, such as companies that assist us with marketing, analytics providers, advertising networks and cooperatives, third parties that share information with us about the various devices you use online, reviews you have posted on third-party sites about products we offer, and other third parties with whom we collaborate or work.

We collect personal information through the use of automated technologies.

Personal information is also collected and shared with us via automated technologies when you visit our Website, use our Apps, open an email, or click on one of our advertisements.

When you access our Website and/or Apps, we automatically create website and mobile application log files. Furthermore, we use automated data collection technologies like cookies, beacons, tags, software development kits (SDK), and scripts to analyse trends, administer the Websites and Apps, and track users' movements around the Websites and Apps. These technologies are also used by us and our third-party service providers to collect demographic information about our user base, both individually and in aggregate.

When a person visits a website, a "cookie" is a small text file that is stored on their computer and downloaded to their computer or mobile device. On each subsequent visit, cookies send information back to the originating website or to another website that recognises that same cookie. We employ the following cookie types:

  • Essential Cookies are required for the proper operation of our Websites and Apps and cannot be disabled in our systems. If you disable these cookies, some features of our websites and apps may not function properly.

  • Functionality and performance Cookies enable us to count visits and traffic sources on our Websites and Apps in order to measure and improve performance and functionality. They assist us in determining which pages of our Websites are the most and least popular, which App features are the most frequently used, and how visitors move around the Websites and Apps.

  • Our advertising partners may place targeted advertising cookies on our Websites. Advertising companies may use them to create a profile of your interests and show you relevant advertisements on other websites.   • Social Media Cookies enable you to share information on social networks such as Facebook, LinkedIn, Pinterest, Instagram, and Twitter by using social media sharing buttons. The social media network may then use this information to deliver targeted advertising to you.

We may combine information automatically collected (as described above) from your interactions with our Services and your activity on third-party sites with other data (including personal information).

If you do not want to accept certain cookies, you can change your browser settings so that cookies from our Websites and Apps cannot be set (see Targeted Advertising in the Your options and legal disclosures section below for your options). Please keep in mind that deleting, blocking, or otherwise restricting cookies, or using a different computer or Internet browser, will require you to renew your cookie management preferences.

 

How we make use of personal information

We use personal information, including information gleaned from your interactions with our Websites and Apps, in-store, your device, or third parties, to run our business and provide you with the best products, services, and experiences possible. We understand how important your personal information is to you, so we want to be open about how we use it. The following are the ways we use your personal information:

  • To give you access to the Websites and Apps, including to service your account(s) and memberships and to keep both secure.

  • To provide you with products and services, including the fulfilment of your orders, the processing of your payments, and the provision of products and services that we believe you will enjoy.

  • To respond to or notify you, such as when you place an order, initiate text messaging as a Lontano Design credit card holder, obtain information about your credit account (including balance, available credit, and other similar information), obtain a QR code in store for same-day purchases, contact us with a comment, request, or question, enter a contest or sweepstakes, complete a survey, and consent to a store team member emailing, texting, or calling you about products.

  • To personalise your interactions with us, including remembering your interests and preferences, customising the products and services we share with you, facilitating interactions with our stylists and store team members, tracking and categorising your activity and interests on the Websites and Apps, including identifying and linking the various devices you use, and enriching your experience in our stores, on the Websites, and on the Apps.

  • For marketing and advertising purposes, including sending you marketing and advertising communications tailored to your interests as well as communications of a more general nature.

  • When you are near our store or store systems, have not disabled location sharing in your device settings, have installed any of our Apps, and your device accesses our store Wi-Fi services, we will offer you personalised content.

  • For analytics purposes, such as understanding how you use our Websites and Apps, how you shop with us, the methods and devices you use to access our Websites and Apps, and improving our Websites and Apps.

  • To manage our Lontano Design loyalty programme, including new member enrollment and account management.

  • For business purposes, such as operating and improving our business and activities, conducting research, maintaining our programmes, accounts, and records; understanding your satisfaction with our products and services, including the Websites and Apps; detecting and preventing fraud or misuse of our services; and any other business purpose permitted by law.

  • To defend or protect us, you, our customers, or third parties from harm or legal proceedings; to maintain the security of our customers, employees, and property; to respond to court orders, lawsuits, subpoenas, and government requests; to address legal and regulatory compliance; and to notify you of product recalls or safety issues.

As previously stated, we collaborate with third-party companies to support our advertising and marketing efforts, such as serving interest-based advertisements across the Internet; tracking and categorising your activity, interests, and device(s) used over time on our Websites and Apps, as well as third-party websites and mobile applications. The advertising networks and related providers use this information to create individual profiles that are shared with us, allowing us to match those individual customer profiles with advertisements we believe may be most relevant to a specific customer

We may also share other information at our discretion, such as data collected by automated technologies that may be used by third parties for marketing, advertising, and other purposes. Partners in targeted advertising

We collaborate with and provide certain personal data (identifiers, commercial information, contact preference information, demographic information, location or geolocation information, Internet or other electronic network activity information, and inferences) to third-party businesses that assist with our advertising and marketing initiatives, including to serve interest-based advertisements across the Internet; track and categorise your activity, interests, and the device(s) you use; and measure the effectiveness of our advertising and marketing campaigns. Our ability to match these unique customer profiles with advertisements we think may be most relevant to a given customer is made possible by the advertising networks and associated providers who collect this information and disclose it to us.

We reserve the right to disclose additional data at our discretion, including data gathered through automated means that could be used for marketing, advertising, or other purposes by third parties. Third-party analytics providers are used by us.

We are delighted when customers contact us to provide feedback on the products and services they have purchased and the services we provide. If you ask a product question, respond to a product question, or submit an online review, including photos, please be aware that this feedback may be publicly shared and used by us on the Websites or Apps without compensation or attribution.

Legal disclosures and your options

Examining your personal data. By logging into your account on the Websites, you can access your name, email address, billing address, shipping address, payment methods, transaction information (orders, purchases, and returns), Lontano Design Club information, and email.

Modifying your personal data. By logging into your account on the Websites, you can also change or update your name, email, billing or shipping addresses, some shopping preferences (like your preferred store location), and payment methods. You can also ask us to update your personal information by writing to us at the postal address or email address listed in the section below titled "Contact us."

Specialised marketing. By changing your settings for each device and browser you use with the Websites and within each App you use, you can choose not to have information about your browsing activities on our Services used to serve you ads on other websites and services. Please visit our opt-out page to change the settings for Lontano Design and Lontano Design Rack. By visiting the Digital Advertising Alliance's consumer choice tool or the Network Advertising Initiative's consumer opt-out page, you can also choose not to receive targeted advertising from specific businesses that take part in third-party industry groups. When using our Apps, your device settings may also provide you with additional privacy options; for more information, please refer to your device's settings. Please take note that you will still receive advertisements even if you choose not to receive interest-based advertising; however, these advertisements will be of a more general nature.

Email options. You can unsubscribe from marketing or advertising emails by following the unsubscribe link in the promotional email or by logging into your account and indicating your preference. You can also request to be removed from marketing or advertising emails by emailing privacy@lontanodesign.com. Please keep in mind that even if you opt out of receiving marketing messages, you will continue to receive transactional and service-related emails from us (such as emails related to your order, your membership in our Lontano Design Club, correction of personal information, password reset requests, reminder emails you have requested, updates to our terms and policies, and other similar communications essential to your transactions on the Websites or Apps). If you have any questions about your Lontano Design credit card or transactional emails, please call (…), and if you have any questions about your Lontano Club membership, please call (….).

Options for direct mail. By logging into your account on our Websites and indicating your preference, you can opt out of receiving marketing or advertising via direct mail. Alternatively, you can contact us using one of the methods listed in the Contact us section below and provide your name and mailing address to opt out. Please keep in mind that these requests may take up to 8-10 weeks to be implemented.

Telephone options (calls and texts). You can opt out of receiving text messages by texting "Stop" at the end of any message you receive, or you can opt out of marketing or advertising calls by contacting us using one of the methods listed in the Contact us section below and providing the phone number from which you want to be removed.

Options for mobile location. If you use our Apps, you can decline to provide location information through your mobile device settings or any prompt that asks for it. We may collect location data (where your device settings allow) when you instal the Apps and your device is near one of our stores, even if you are not currently using the Apps, as previously stated. You can avoid this by changing the settings on your mobile device to prevent the sharing of location information.

In some jurisdictions, you may have additional rights. Customers residing in California, Colorado, Connecticut, Virginia, or Utah have additional rights under applicable law (see below for information on the rights granted for each state and when those are effective). By filling out our online form, you or your legally designated representative can request to exercise your rights. We recognise that some customers may have difficulty using the online form or would prefer support from our team to complete it; you can get help by calling (…….). For more information on our process for determining whether we have received a legally valid request, please see the Identity verification requirement section below.

Rest assured that if you choose to exercise any legally available rights as described in this Policy, Lontano Design will not discriminate or retaliate against you. If you want an authorised agent to submit a request on your behalf, please send us an email at privacy@lontanodesign.com with the instructions and additional information we require to respond to a request submitted by a legally authorised agent.

Identity verification is required. The law requires us to validate the identity and legal authority associated with certain personal information requests, including for customers residing in the states listed below that grant additional rights. As a result, we may require you to take additional steps to validate your identity and legal authority, especially if you submit your request via our online form or in writing (email or postal mail). If you submit a request online or through our Customer Care centre, we will send an email to the email address you provided in your request, and you must validate your request within seven (7) days of receiving that email. Once you have completed the email validation process or provided the requested additional information, your request will be considered validated. If you do not confirm your request within the specified timeframe and/or do not provide the requested additional information, your request will be considered invalid and closed.

We will respond to any request for personal information within the timeframe required by law. If we are unable to respond substantively to your request in a timely manner, we will notify you and explain why.

We may be unable to fulfil your request in certain circumstances, such as when doing so would conflict with our regulatory or legal obligations, when we are unable to verify your identity, or if your request involves a disproportionate cost or effort. However, as required by law, we will respond to your request within a reasonable time and provide an explanation.

For those of our clients who live in California

We must give residents of California certain disclosures, including an explanation of their legal rights, per California law. This section applies in addition to all other applicable rights and details in this Policy if you reside in California and are a customer of Lontano Design.

Disclosures from California. For information on the categories of personal information we collect and categories of recipients to whom we have disclosed such information over the previous 12 months, please see the What personal information we collect and When we disclose personal information sections above.

The Lontano Design Club and a warning about a reward. Customers who sign up for our Lontano Design Club loyalty programme receive exclusive deals and benefits. Customers can sign up in-person or online. As part of the credit card application process, Lontano Design credit card holders sign up for The Lontano Design Club. Members of the Lontano Design Club can accrue points by buying specific goods or services. When converted into Lontano Design Notes, these points can be used toward upcoming purchases from Lontano Design. You can read more about the Lontano Design Club here, along with information on how to earn Lontano Design Notes and other Lontano Design Club perks. The Lontano Design Club membership is completely optional, and members can cancel their participation at any time by calling our customer service department at (….). Customers' names, email addresses, and phone numbers are requested when they sign up for The Lontano Design Club so that we can send them information about rewards and programmes (including pertinent marketing) and make sure that purchases are linked to the right Lontano Design Club account. A Lontano Design Club member may also provide us with personal information through their Lontano Design account, including their username and password, billing, mailing, and shipping addresses, phone number, information about their preferred brands and payment information (such as credit card information), or through purchases they make online or in-person. We gather the same personal data as we do from other Lontano Design customers as described above when a Lontano Design Club member uses our website, mobile app, or makes a purchase.

While we do not put a price on the personal data that Lontano Design Club members provide us in exchange for the advantages that the programme provides, we do get value in the form of steadfast customer support and elevated purchase engagement. We calculated the value to Lontano Design by subtracting the costs associated with offering the Lontano Design Club programme and benefits from the revenue generated from activities related to the collection and retention of members' personal information. Depending on purchases made, where they were made (in-store or online), which offers a member takes advantage of, and a variety of other factors, this value will vary from member to member.

Your legal rights in California. As a California resident, you have the following rights:

  • To learn more about your personal information and gain access to it.

  • That we correct any incorrect personal information about you.

  • That your personal information be deleted.

Furthermore, under California law, you have the right to request that we limit the use of your "sensitive" personal information. Lontano Design does not make inferences about you based on sensitive personal information and only uses sensitive personal information for purposes permitted by the California Consumer Privacy Act.

The rights granted to you under California law may allow us to make exceptions to fulfilling your request, such as when we need to retain the information to fulfil a legal obligation, complete a transaction with you, prevent fraud, or for any other lawful purpose.

If you want to appeal a decision we made about your personal information request, please send an email to privacy@lontanodesign.com within 14 days of receiving our final response. Include the phrase "Data Subject Rights Appeal" in the subject line of your email, and include your name, the original request case number, the email address associated with your request, and any other information that will help us investigate your appeal. We will respond to your request for an appeal in a reasonable amount of time and in accordance with applicable law.

Please do not sell or distribute my personal information.

As previously stated, we collaborate with certain advertising partners to display ads that are relevant to your interests. Under California law, these activities may be considered "selling" or "sharing" of your personal information. To opt out of these activities, fill out our online form and adjust settings for each device and browser you use with the Websites, as well as within each App you use. Please visit our opt-out page to change your Lontano Design settings. Alternatively, you may use a legally recognised device or a browser-based universal opt-out mechanism, such as the Global Privacy Control, to access our Services. Please keep in mind that we may continue to collect and share personal information about you with third parties, including to continue providing services to you, where sharing of your personal information is permitted by law for purposes other than targeted advertising. When you tap the "confirm" button after adjusting your settings via the settings link above, you will only opt out of any sharing activity on the browser and device you are using for the Lontano Design-branded website (e.g., Lontano Design.com) you are visiting. If you use the Apps, you must also opt out of the "selling" activity by selecting the Do Not Sell My Personal Information menu item for each App.

Metrics for Requesting Privacy Rights in California (January 1, 2021, to December 31, 2021)

For those of our Virginia customers

Virginia law requires us to provide certain disclosures, including a description of legal rights, to Virginia residents. If you live in Virginia and are a customer of Lontano Design, this section applies in addition to all other applicable rights and information in this Policy.

As a Virginia resident, you have the following options:

  • To learn more about your personal information and gain access to it.

  • That we correct any incorrect personal information about you.

  • That your personal information be deleted.

  • To opt out of having your personal information processed for the purpose of providing you with targeted advertising.

For more information on how to exercise these rights, please see the Your options and legal disclosures section of this Policy. To opt out of targeted advertising, fill out our online form and adjust your settings for each device and browser you use with the Websites, as well as within each App you use. Please visit our opt-out page to change your Lontano Design settings. Alternatively, you may use a legally recognised device or a browser-based universal opt-out mechanism, such as the Global Privacy Control, to access our Services. Please keep in mind that we may continue to collect and share personal information about you with third parties, including to continue providing services to you, where sharing of your personal information is permitted by law for purposes other than targeted advertising. When you tap the "confirm" button after adjusting your settings via the settings link above, you will only opt out of any sharing activity on the browser and device you are using for the Lontano Design-branded website (e.g., Lontano Design.com) you are visiting. If you use the Apps, you must also opt out of the "selling" activity by selecting the Do Not Sell My Personal Information menu item for each App.

The rights granted to you under Virginia law may allow us to make exceptions to fulfilling your request, such as when we need to retain the information to fulfil a legal obligation, complete a transaction with you, prevent fraud, or for any other legal reason.

If you want to appeal a decision we made about your personal information request, please send an email to privacy@lontanodesign.com within 14 days of receiving our final response. Include the phrase "Data Subject Rights Appeal" in the subject line of your email, and include your name, the original request case number, the email address associated with your request, and any other information that will help us investigate your appeal. We will respond to your request for an appeal in a reasonable amount of time and in accordance with applicable law.

Lontano Design does not collect or process "sensitive" personal information as defined by the Virginia Consumer Data Protection Act.

For our Canadian customers

Our Canadian customers have specific rights under Canadian law. This section applies in addition to all other applicable rights and information in this Policy if you are a Canadian resident and a Lontano Design customer.

You have the right to access your personal information under Canadian federal law. If you have an account with us, you can access and update your account information (as described above) by logging into your account. You can also ask us to delete your personal information. To request access to information not contained within your account or to have your personal information deleted, please fill out our online form or write to us at the email or postal mail address listed in the Contact us section below.

Identity verification is required. The law requires us to validate the identity of a Canadian customer before we honour a personal information request from them. As a result, we may require you to take additional steps to validate your identity or legal authority, especially if you submit your request via our online form or in writing (email or postal mail). If you request access to or deletion of your personal information, we will send an email to the email address you provided in your request, and you must follow the instructions in that email in order for us to verify your request. Once you have completed the verification process, we will begin processing your request.

We will respond to any request for personal information within the timeframe required by law. If we are unable to respond substantively to your request in a timely manner, we will notify you and explain why.

We may be unable to fulfil your request in certain circumstances, such as when doing so would conflict with our regulatory or legal obligations, when we are unable to verify your identity, or if your request involves a disproportionate cost or effort. However, as required by law, we will respond to your request within a reasonable time and provide an explanation.

For those of our clients who live outside of the US and Canada

Customers in nations outside of the United States and Canada, such as the European Economic Area (EEA), Switzerland, and the United Kingdom, cannot purchase Lontano Design products directly from the company's website (UK). Orders placed through our websites or apps and shipped outside of the US and Canada. Lontano Design will obtain any identifying data related to those orders. To fulfil orders, Lontano Design may have access to personally identifiable information under its control. Please get in touch with Lontano Design if you have any inquiries about its privacy policies (lontanodesign.com).

You acknowledge that if you submit personal information through the Websites or Apps without making a purchase, that information may be transferred to and processed in the United States of America and any other nation or jurisdiction we deem appropriate. There may be differences between the laws and safeguards in your country and those that govern the use and protection of personal information in the United States and other nations or jurisdictions where we transfer or process personal information.

We are not responsible for the sites, content, or videos accessible through those links, and we have not reviewed those third parties' privacy practises.
